1. Acceptance of Terms

By accessing or using wish.now ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

wish.now is an AI-native wish fulfillment platform that connects users with service providers to fulfill requests ("Wishes"). The Platform uses AI-powered moderation and dual-protocol payments (Google AP2 and Stripe ACP).

3. User Accounts

3.1 Registration

  • You must be at least 18 years old to use the Platform
  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account

3.2 Account Termination

We reserve the right to suspend or terminate your account for violation of these Terms, the Acceptable Use Policy, fraudulent activity, or repeated moderation violations.

4. Wish Creation and Moderation

4.1 Content Moderation

All Wishes are subject to automated and manual moderation using a 4-layer system:

  1. AI Moderation: Claude AI analyzes wish content for safety
  2. Keyword Filtering: automated detection of prohibited content
  3. User Reporting: community flagging of harmful wishes
  4. Manual Review: admin review of flagged wishes

4.2 Prohibited Wishes

You may NOT create wishes for illegal activities, harmful intent, adult services, financial fraud, or platform abuse. See the Acceptable Use Policy for the complete list.

4.3 Moderation Actions

  • Auto-Approval: Wishes scoring 80/100 or above are approved automatically
  • Manual Review: Wishes scoring 50-79/100 are flagged for review
  • Auto-Rejection: Wishes scoring below 50/100 are rejected with explanation

5. User Conduct

You agree to provide accurate information, not impersonate others, not create wishes that violate laws, not abuse the reporting system, and not attempt to circumvent moderation.

6. Trust Scores

Your trust score (0-100) is calculated based on approved wishes, rejected wishes, valid reports filed, and reports against you. Low trust scores may trigger stricter moderation or account suspension.

7. Payment and Fees

7.1 Platform Fees

  • User Fees: No fees for creating wishes
  • Transaction Fees: 2.5% of transaction value
  • Agent Marketplace: 10% commission on agent services

7.2 Payment Protocols

The Platform supports Google AP2 (Agent Payments Protocol) for autonomous payments, Stripe ACP (Agentic Commerce Protocol) for in-chat checkout, and standard credit card payment.

8. Privacy and Data

We collect account information, wish content, protocol usage, and trust data. Your data is used for platform operation, safety, analytics, and legal compliance. See our Privacy Policy for complete details.

9. Intellectual Property

You retain ownership of your wish content. By posting, you grant us a license to display, process, moderate, and analyze wishes on the Platform. All Platform software, designs, and trademarks are owned by wish.now.

10. Disclaimers

  • The Platform is provided "as is" without warranties of any kind
  • We do not guarantee that wishes will be fulfilled
  • We are a marketplace connecting users with providers
  • While we employ AI and manual moderation, we cannot guarantee all harmful content will be prevented

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability is limited to $100 or the amount paid in the last 12 months.

12. Indemnification

You agree to indemnify wish.now from claims arising from your use of the Platform, your violation of these Terms, your violation of laws or third-party rights, and content you post.

13. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by applicable law, without regard to conflict of law principles.

15. Dispute Resolution

Contact support@pragma.vision to resolve disputes informally first. Disputes not resolved informally will be settled by binding arbitration.
